Prima che il covid19 monopolizzasse le tematiche nazionali, in ogni ambito sociale ed economico, chiunque avesse chiesto ad un addetto del settore Ho.re.ca. quale fossero i problemi e l’ambito in cui si sarebbe dovuto intervenire nel mondo della ristorazione, la risposta sarebbe stata pressoché univoca: CONTRATTI NAZIONALI DEL LAVORO.

Una risposta apparentemente netta e semplice da capire.
Quello che invece non è così chiaro è la domanda a cui questa risposta generale vorrebbe dare soluzione.

E partiremo proprio dalla domanda, che abbiamo cercato in questi 5 anni di OCCCA.

“Esiste nel settore Ho.re.ca., uno o più elementi che determinano un condizionamento del settore verso la competenza e professionalità?”

Ovvero, c’è qualcosa che permetta di escludere il titolare incapace, farabutto, scorretto dall’aprire o condurre per un lungo periodo la sua attività?
E altrettanto si può dire che esista un elemento che non premi quel dipendente poco professionale, incompetente, con scarsa etica e condotta?

A parte il buon senso, che è soggettivo, la risposta ad oggi è no.
Nemmeno il mercato riesce a essere un elemento invalidante.

Il bar con la dipendente avvenente e scollata, può tranquillamente avere un incasso maggiore del Cafè dove trovare più professionalità e cortesia. Certamente brutto e triste da dire, ma delle semplici tette fanno ancora la differenza.

“È solo una questione di fortuna?”

Sono luoghi comuni è vero, ma luoghi comuni che ancora resistono, come il cocktail bar o ristorante frequentato da spacciatori, o dove le materie prime sono pessime, i dipendenti pagati in modo più che irregolare e i prezzi sono convenienti per i clienti, a discapito di un mercato che non sa e non può calmierare i menù in modo univoco.

I fatti ad oggi sono questi.
Fortunatamente non è così dappertutto. Esistono ristoranti gestiti da ristoratori che sanno essere imprenditori capaci, con personale qualificato e una clientela pagante per la professionalità che le viene venduta assieme al risultato di un lavoro di squadra.

Ma appunto, è questione di fortuna.
Fortuna che tutti noi, da dipendenti, ci siamo andati sempre a cercare. Magari cambiando città, regione, persino paese e continente.

Una fortuna che anche i ristoratori spesso devono pregare, a causa di una concorrenza sleale che a volte possono farti perdere, non potendo giocare alla pari su un campo dove sembra che le regole non siano le stesse per tutti.

Non vi è mai capitato di veder fallire un locale dove da clienti (ed addetti del settore) eravate più che entusiasti, perché riconoscevate la perfezione di ogni dettaglio, dalla proposta commerciale alla qualità del servizio, che si sono scontrati con la realtà di provincia dove a volte vengono premiate altre attività che sono meno professionali, oneste, etc.? Clichè che in parte stanno sparendo, ma che ancora resistono.

“Il lavoro, nella ristorazione, è un PRODOTTO di cui ad oggi, non è chiaro il posizionamento.”

Ecco che allora la domanda diventa fondamentale.
Perché a noi non serve solo una nuova formula contrattuale.
Non basta avere un costo del lavoro minore.
Rischieremmo di avere solo una parte della soluzione, scoprendo che i problemi di sempre restano. Il modello sbagliato che tutti criticavamo prima del covid19 si adatterebbe e continuerebbe a renderci vittime della fortuna/sfortuna.

Si può trovare una soluzione a questo problema e avere un mercato che non risponda alla fortuna ma ad un metodo?
Un sistema coerente che mantenga il buono ed escluda quello che non lo è, senza pensare di poter avere una buona ristorazione solo grazie all’intervento continuo e sistematico di controlli che puniscano il male facendo prevalere il bene?

Se l’Haccp ci ha dimostrato che stabilendo e registrando ogni passaggio di filiera si può avere la certezza di un prodotto salubre, io credo che la stessa cosa possa avvenire per il “prodotto lavoro”.

Perché in effetti di questo dovremmo innanzitutto parlare.
Il lavoro, nella ristorazione, è un PRODOTTO di cui ad oggi, non è chiaro il posizionamento.

Chiedete ad un cameriere, un cuoco, un pizzaiolo o anche semplicemente ad un lavapiatti, quale dovrebbe essere il suo stipendio.
La prima risposta sarebbe – “Dipende”.

Poco male se quel “dipende” fosse relativo alle ore di lavoro.
Di elementi e variabili ce ne sono tantissimi, comprese le formule contrattuali regolari solo in parte o affatto.
Praticamente ognuno fa caso a sé.
Anche quelli che sono regolarmente contrattualizzati.
I contratti di lavoro nel nostro settore non sono altro che un vestito più o meno regolare, con i suoi relativi costi in base a tale regolarità, da indossare sopra un patteggiamento di ambo le parti su quello che dovrà realmente essere il compenso stabilito.

“Quindi abbiamo un prodotto “LAVORO” che non corrisponde alle esigenze di ingaggio, che non è chiaramente identificabile rispetto alle molteplici realtà che viviamo tutti i giorni e in ultimo, ma fondamentale, non garantisce una selezione metodocratica da parte di una ristorazione capace e professionale.”

E fino ad ora abbiamo parlato solo dell’aspetto economico.
La parte economica, riguarda più in generale quelli che sono i DIRITTI del lavoratore. Essi sono composti da una retribuzione ma anche, un’assicurazione sanitaria e altri sostegni che l’azienda è tenuta a elargire.

E i DOVERI? Quanti possono asserire di adempiere ai doveri verso il quale un contratto formale li obbliga?
Quanti chef capo partita risultano non avere le competenze per le quali sono stati assunti?
Quanti apprendisti che fanno la chiusura cassa?
E gli aiuto-cucina di quinto livello che gestiscono magazzini e ordini?

Tutti questi elementi di DIRITTI e DOVERI vengono solo in parte e spesso di facciata descritti dal contratto. Il resto per opportunismo, ma anche per i limiti degli attuali strumenti dati dai vari CCNL, sono spesso ridotti, di nuovo, ad un informale accordo da ambo le parti.

Quindi abbiamo un prodotto “LAVORO” che non corrisponde alle esigenze di ingaggio, che non è chiaramente identificabile rispetto alle molteplici realtà che viviamo tutti i giorni e in ultimo, ma fondamentale, non garantisce una selezione metodocratica da parte di una ristorazione capace e professionale.

In un anno di covid19 non abbiamo sentito una associazione di categoria, un blogger, una testata giornalistica, porsi questa domanda. In un anno di semi-blocco totale delle attività di un mercato che solitamente ha solo il tempo per andare a dormire per poi ricominciare a lavorare, in un’occasione così nefasta ma anche rara nella sua capacità di mettere tutti all’ascolto, nessuno ha pensato fosse il caso di iniziare quantomeno un percorso risolutivo al problema che avevamo prima, abbiamo ora e avremo quando la pandemia sarà terminata?

A non voler pensare male, viene da chiedersi se sia una questione di abitudine e CHIUSURA MENTALE.

Apro la mia mente all’opportunità di poter rendere un momento drammatico in un’opportunità e vi invito a fare lo stesso.

Oggi si parlerà per un altro motivo di questo hashtag, #ioapro, ma sono pronto a scommettere che lunedì tutti avranno già dimenticato la forzatura di pochi ristoratori verso le attuali restrizioni.
Dimenticherete allo stesso modo che avevamo un problema, abbiamo un problema e continueremo ad avere un problema, se non decideremo di affrontarlo?
